LIBER Response to the EC's Green Paper on the online distribution of audiovisual works in the EU

LIBER welcomes the Commission’s efforts to harness the opportunities offered by new technology to boost the market in audiovisual content. But we fear that the Green Paper is too narrow in scope, in terms of the types of institutions that it addresses (namely only film heritage institutions) and in terms of the types of activity that it proposes to harmonise (preservation and in-house consultation).

As it now stands the Green Paper offers no solutions to provide legal certainty for all types of cultural and research institutions holding AV content in their collections to fulfill their public interest mission in the 21st century. Digital technologies and the internet could allow cultural and research institutions to provide educational and cultural online access and digital re-use: but the legal regime frustrates modern development for this purpose. In short, the Green paper fails to address the infamous 20th century black hole of AV content, entailing the risk of condemning the fascinating collections of cultural and research institutions to perpetual oblivion.
